  • Yes but if you actually read the report, at the attorney’s arraignment the prosecuting DA put on the record that the chef hit the attorney first. Not attorney’s fault that he could defend himself well.

    FYI this whole thing started when the *baker* threw out a paying 55 year old black female foregin customer for no reason
    this is all public record and soon to be sorted out in court
    i’m all for public discourse but you should research your facts a little more

  • Facts: Pastry chef asked her to leave because she was waiting for the bus (perhaps not the best customer service policy, but certainly within his rights as a business owner). Weed-loving “attorney” showed up to demand an apology and started knocking down tables and chairs. Pastry chef attempted to restrain him and ended up in the hospital with 10+ stitches. Attorney was charged with assault and drug possession.

    Maybe someone is holding a grudge?

    I will respond as I am tired of misinformation around here, but this really is not the proper forum. All will be clear in court.
    I do have to say she was a PAYING customer who bought a croissant and then was thrown out into a cold night. We all know many people just go in there to wait for the bus w/out buying a thing, and don’t get thrown out- Poussot’s attorney has admitted this in the paper. She went in and bought a snack.
    Some people around here seem to value access to baked good more than the law. What he did was a crime and it will be proven so.
    If you have further ‘facts’ to dispute, I suggest you read the lawsuit w/ her sworn statment and read all the court papers. What you say about Poussot’s story is just that- a story. Not a sworn document in a court of law. If you know him, as I suspect you do, ask to see the security camera video tape of the night she went in, and the day the attorney was there.
    Attorney was not charged with destruction of property.
    As I said earlier. The trial is the proper forum for the real facts to come out.

  • Thanks so much for posting the lawsuit. Having read it, I have to say, as both a lawyer and a black man, there is no case. Feel bad that the woman was insulted, but it doesn’t rise to the level of discrimination. The proprietor is guilty only of being rude, at most. Also found it interesting how there is no mention of the altercation in the suit. Hmmm. Perhaps you could get a hold of the police report. Lastly, I know some may feel that DumboNYC may not be the forum for this, I disagree. This is a Dumbo shop, arguably a mainstay (rare in these parts), who rents from Walentas (not to mention Jacques Torres, who has become synonymous with Dumbo) in a dispute with a Dumbo resident and his employee. That’s Dumbo news.

    I read that and the Daily News and the previous Brooklyn Papers article and the filed lawsuit papers linked to above and I think it’s all just a shame. Here’s the way I see it – Herve (the baker) was rude, Sean (the woman’s employer) came in angry to demand an apology, tempers flared on both sides and it got out of hand, the police were called and now there’s a lawsuit filed. Seems to me both parties should be adults, apologize nicely and sincerely to each other for their rude behavior (both of them – the cursing, throwing furniture, punching, tackling, yelling – all uncalled for) and put this behind them. They need to set an example for their kids (both Herve and Sean have children) and for the neighborhood as a whole.

    I’m not an expert in discrimination, but I don’t see it in this case. Even the lawsuit filed says the woman who was thrown out was a FREQUENT customer and it never says she was treated rudely or with discrimination before, which, you know, any good lawyer would have put into the lawsuit papers if it existed. So one time after her many visits to the bakery Herve gets angry and rude and throws her out. I’m not sure that makes him a racist or just an over reacting jerk.
